Terms of Service
Terms and conditions governing the use of our subscription services and payments.

1. Acceptance of Terms
By accessing and using our services, including our LMS hosting, website hosting, and DevSecOps support subscriptions, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use our services.
2. Description of Services
We offer the following subscription-based services:
- LMS Hosting: Managed Learning Management System hosting with learner capacity tiers, including Moodle hosting with plugin management, reporting, backups, and SSO integration.
- Website Hosting: Shared, VPS, and managed hosting solutions with SSL, monitoring, staging environments, and CDN/WAF services.
- DevSecOps Support: Ongoing cloud security, infrastructure management, observability, and FinOps support for cloud workloads.
One-time services such as website creation and DevSecOps assessments are also available as noted in our pricing.
3. Subscription Terms and Billing
3.1 Subscription Plans
We offer monthly and annual subscription plans for our hosting and support services. Pricing varies based on the service tier (Starter, Growth, Scale) and the specific requirements of your deployment. All prices are quoted in South African Rand (ZAR) unless otherwise specified.
3.2 Payment Terms
Payments are processed securely via Paystack. For monthly subscriptions, payment is due on the same date each month as your initial subscription date. For annual subscriptions, payment is due annually on the anniversary of your initial subscription date. All fees are exclusive of applicable taxes unless stated otherwise.
3.3 Automatic Renewal
Your subscription will automatically renew at the end of each billing cycle unless you cancel at least 14 days before the renewal date. By subscribing, you authorize us to charge your payment method for subsequent billing periods.
3.4 Failed Payments
If a payment fails, we will attempt to charge your payment method again within 7 days. If payment remains unsuccessful, your subscription may be suspended, and access to services may be restricted until payment is received.
4. User Responsibilities
You agree to:
- Provide accurate and complete information when using our services and during registration
- Maintain the security of your account credentials and payment information
- Use our services only for lawful purposes and in compliance with all applicable regulations
- Not attempt to gain unauthorized access to any systems, networks, or other users' data
- Keep your contact and billing information up to date
5. Cancellation Policy
You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. You will continue to have access to your services until the end of the billing period for which you have already paid. No refunds are provided for partial billing periods. 6. Refund Policy
We offer refunds in accordance with our Refund Policy. Generally, refunds are available within the first 14 days of a new subscription for first-time customers, subject to certain conditions. Please refer to our separate Refund Policy for complete details on eligibility, processes, and exceptions.
7. Service Level Agreements
Service level commitments vary by subscription tier. Higher tiers (Growth, Scale) include enhanced SLAs with guaranteed uptime percentages and response times for support requests. Specific SLA details are available in our service agreements and vary based on the service selected.
8. Data and Security
We implement appropriate technical and organizational measures to protect your data. Customer data is hosted in secure AWS regions (Johannesburg, Cape Town, or N. Virginia depending on requirements) or trusted South African colocation facilities. Backups are performed regularly according to your service tier. Please refer to our Privacy Policy for complete information on data handling.
9. Intellectual Property
All content, features, and functionality of our services are owned by us and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission. Your data and content remain your property.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services. Our total liability shall not exceed the amounts paid by you in the 12 months preceding the claim.
11. Disclaimer of Warranties
Our services are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the operation, availability, accuracy, or reliability of our services. We do not warrant that our services will be uninterrupted, timely, secure, or error-free.
12. Termination
We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including breach of these Terms of Service. Upon termination, you will remain liable for any outstanding payments, and your right to access services will cease immediately.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of South Africa.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. Continued use of our services after such changes constitutes acceptance of the new Terms.
